Labor Class Actions

     Hamner Law Offices prosecutes wage and hour class actions on behalf of hundreds of thousands of class members throughout California, and sometimes throughout the country.  We sue for unpaid wages for class members for unprovided meal and rest breaks, unpaid overtime, unpaid off the clock work and mis-classification of non-exempt employees.  Because many employees at a company are often owed similar wages for similar labor violations, we prosecute these matters as class actions, seeking money for all similarly situated workers.

    We do not ask for a penny from our clients.  We seek all fees and costs directly from the employer.  We are experienced class action attorneys with a record of successful results.

Who We Represent

     We represent restaurant and hotel workers, amusement park workers, computer and high-tech employees, accounting / CPA trainees and administration, home loan and bank employees, telecommunications sales/administrative employees, retail employees, “piece-rate” employees, commission sales employees and oil and refinery workers.  We focus on the computer and Internet industries, and the food service industry.  Many of these workers are owed significant sums from their employers.

     In the computer and internet industries, many so called salaried or exempt workers are misclassified and therefore not paid thousands in earned wages.  Mid level IT professionals, such as engineers, designers and developers are classified as exempt from overtime, and then asked to work nights and weekends from home.  These computer and internet workers are owed overtime / additional wages under California law. 

  Likewise, accounting trainees (accountants who have not yet earned their CPA) and others working in accounting administration must be paid overtime, even if they are salaried or exempt.  Many large accounting firms do not pay their non-CPAs these overtime wages.  Because of this, these workers are often owed significant amounts of unpaid wages form their former their employers.

     Many hourly workers at restaurants, hotels and amusement parks throughout California are also not paid all their wages, or provided legal required rest and meal breaks.  The businesses must provide rest and meal breaks to their workers.  After 5 hours, these hourly workers must be given an uninterrupted 30 minute lunch break, or the employee is owed additional wages.  It is also unfair and illegal for these hourly workers to be required to work "off the clock." 

 Why It's Important

     California workers have a Constitutional Right to their earned wages. For every hour worked, workers must be paid. For every hour of overtime worked, workers must be paid overtime. On long and demanding shifts, employers should ensure their workers get breaks or pay additional wages.  When large companies misclassify whole departments to avoid paying overtime, these workers are entitled to be paid for all of their time worked.
